These Terms of Service ("Terms") govern your use of the Rally mobile application and related services (collectively, "Rally"). Rally is operated by Rally Gameday, LLC ("Rally," "we," "us," or "our"). By creating an account or using Rally, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Rally.
Rally is for adults age 18 and older. You may not create an account or use Rally if you are under 18 or are prohibited from using the service under applicable law. You must provide accurate information, including your date of birth, and may not misrepresent your age or identity.
You are responsible for activity under your account and for keeping your credentials secure. Do not share your account, impersonate another person, create accounts to evade enforcement, or use another person's contact or payment information without permission.
You may request deletion from Settings → Delete Account. Account access and public profile information are removed promptly, and uploaded files are deleted from storage when the deletion completes. Messages you sent in group chats may remain visible to other members under a deleted-account placeholder. Transaction, fraud-prevention, safety, audit, backup, or legally required records may be retained as described in the Privacy Policy.
The application is licensed, not sold. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Rally for lawful, personal purposes and for peer-to-peer selling or Rally Partner activities expressly enabled by Rally, but not for other commercial exploitation, on devices you own or control.
For downloads through Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies to the licensed application. These Terms govern Rally's services and community. If these Terms conflict with Apple's Standard EULA for the licensed application, Apple's Standard EULA controls for that conflict.
Rally has zero tolerance for objectionable, abusive, exploitative, or illegal content and conduct. You may not:
Rally provides reporting tools on supported user-content surfaces and lets users block other users. If a surface does not present an in-app report action, contact support@rallyfindyourcrowd.com. We may review reports, preserve relevant evidence, remove or restrict content, limit features, and suspend or ban accounts. We prioritize credible safety threats and illegal content; no response-time guarantee is made.
You retain ownership of content you submit. You represent that you have the necessary rights to submit it and that it complies with these Terms. You grant Rally a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, display, and distribute that content only as reasonably needed to operate, secure, moderate, and improve Rally. This license ends when Rally no longer needs the content for those purposes, except for copies retained as described in the Privacy Policy, by service providers, or as required by law. Account-deletion and content-removal limitations are described in the Privacy Policy.
Rally may remove or restrict content at any time when we reasonably believe it violates these Terms, creates risk, or is necessary to operate the service.
Rally helps users discover and coordinate third-party and user-hosted activities. Unless Rally expressly says otherwise, Rally does not organize, supervise, inspect, insure, or control them. Hosts and attendees are responsible for their own conduct, permissions, transportation, safety, and compliance with venue rules and law.
Meeting strangers and attending in-person activities involves risk. Use good judgment, meet in appropriate places, tell someone your plans, and contact emergency services if there is immediate danger. Rally is not an emergency service and does not guarantee a user's identity, background, conduct, or the safety or accessibility of a location.
When the ticket marketplace is available, Rally provides technology for users to list and purchase event tickets from one another. Rally is not the ticket issuer, event organizer, venue, buyer, or seller. Marketplace availability, fees, payment mode, and transaction terms are shown in the app before a user commits.
Sellers must own or control the tickets they list, have the right to transfer them, and accurately describe the event, quantity, section, row, seats, price, and restrictions. Speculative, counterfeit, duplicated, already-used, non-transferable, or unlawfully resold tickets are prohibited. Buyers are responsible for confirming event details and providing an email address that can receive the external ticket transfer.
Marketplace payments and seller onboarding are handled by Stripe. Rally does not store complete payment-card or bank-account numbers. Tickets are delivered outside Rally through the applicable ticket issuer's transfer system. Sellers must complete the external transfer and submit proof within the deadline shown in the transaction. Buyers must inspect and accept the transfer, confirm receipt, or open a dispute within the displayed review window.
Fees are disclosed before purchase or listing. Refund eligibility depends on the transaction state, transfer deadline, dispute outcome, event status, applicable law, and the policies shown in the app. A refund may take additional time to settle through the payment provider. Rally may hold, delay, reverse, or refuse a transaction or payout to address fraud, disputes, legal restrictions, provider requirements, or safety concerns.
Rally does not guarantee ticket authenticity, event admission, event occurrence, seat quality, or that a third-party issuer will permit a transfer. Event cancellation, postponement, and issuer refund rights may be controlled by the issuer, venue, organizer, or seller rather than Rally.
Rally relies on third-party services such as Apple, Stripe, Expo, mapping providers, and external ticket issuers. Their separate terms may apply. You must comply with applicable third-party terms when using Rally. We are not responsible for a third-party service's availability, content, or independent acts.
If you believe content on Rally infringes your copyright or other intellectual property, email support@rallyfindyourcrowd.com with your contact information, identification of the protected work, the location of the allegedly infringing material, the basis for your claim, and a statement that the information you provide is accurate. We may remove or restrict the material and notify the submitting user. Knowingly false claims may create liability.
You may stop using Rally at any time. We may investigate, limit, suspend, or terminate access; cancel or hold a transaction; preserve evidence; or refer matters to appropriate authorities when reasonably necessary to enforce these Terms, protect users, prevent fraud, comply with law, or protect the service. Sections that by their nature should survive termination remain effective.
To the maximum extent permitted by law, Rally is provided "as is" and "as available." We do not promise uninterrupted or error-free operation or guarantee the accuracy of sports schedules, user content, identities, listings, event information, maps, or third-party services. Nothing in these Terms excludes rights that cannot legally be excluded.
To the maximum extent permitted by law, Rally and its operator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits or data; or the conduct of users, hosts, attendees, sellers, buyers, venues, issuers, or other third parties. To the maximum extent permitted by law, total liability arising from Rally will not exceed the greater of $100 or the amount you paid Rally in the 12 months before the claim. Some jurisdictions do not allow certain exclusions or limits, so they may not apply to you.
We may update these Terms. We will post the revised version with a new effective date and provide additional notice when appropriate. Material changes apply prospectively. Continuing to use Rally after updated Terms take effect means you accept them.
Except where consumer-protection law requires otherwise, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
